Is Qualiopi mandatory for you? The 5-question test
It is the most widespread misunderstanding among founders of French training organisations: "to be a training organisation, you need Qualiopi". False. Here is what the rule actually says, and a simple test to settle your case.
The rule in one sentence
Since 1 January 2022, Qualiopi certification is mandatory only for providers who want their actions financed by public or pooled funds (article L6316-1 of the French Labour Code). It is in no way a condition of existence: to operate legally, an activity declaration number (NDA) suffices, obtained through the Cerfa 10782 activity declaration.
The funding sources that require Qualiopi
- OPCO (skills development plans of companies under 50 employees, work-linked training…)
- CPF — with extra requirements: you also need a certification registered with the RNCP or the Répertoire spécifique, and an EDOF listing
- The State and the Regions (public training procurement, regional schemes)
- France Travail (AIF and other schemes)
- Agefiph and the Caisse des Dépôts
The situations where Qualiopi is NOT required
- Companies paying from their own funds: an SME settling your invoice without going through its OPCO has no legal certification requirement.
- Self-funding individuals: same (the B2C professional training contract remains mandatory, but not the certification).
- Subcontracting for a certified organisation: when you deliver on behalf of a Qualiopi-certified provider, its certification covers the action. Careful: since the tightened CPF rules, lead providers supervise their subcontractors more strictly and many contractually require guarantees, sometimes the certification itself — check case by case.
- Activities outside vocational training: lectures, unstructured coaching, consulting services.
The 5-question test
- Who pays for your training today? If the answer is "my clients, directly": Qualiopi is not mandatory.
- Do your clients ask for "OPCO funding"? If that phrase keeps appearing in your quotes, the question is no longer legal but commercial: without Qualiopi you will lose those deals.
- Are you targeting the CPF? Then Qualiopi is necessary… and only the first step: you also need an RNCP/RS certification and the EDOF listing — a much longer undertaking.
- Do you work as a subcontractor? Look at your contracts: the requirement comes from the lead provider, not the law.
- Does your growth run through SMEs under 50 employees? Their training budgets are largely OPCO-funded: Qualiopi then becomes a rational commercial investment — count €3,000 to €7,600 over 3 years, all included.
